Hello.This is my first post. I have a question from a client regarding an employee returning from basic training. He was gone about 3 weeks, do they need to do a pre-employment test? Another client asks if a driver is laid off for 1 year, did not wiork elsewhere & is now coming back to work. Do they need to retest.

Welcome to the forum. We need to look at each of the situations one at a time. To start with, if the employee was previously pre employment tested and placed into a random pool and never removed, for FMCSA, the individual does not need to be pre employment tested again. Look at 49 CFR 382.301 for FMCSA pre employment test requirements. Also, FTA pre employment time frames are different, check those.

The individual out of program for a year definitely needs a pre employment test.
You must also take into account company policy and what they chose to do. Welcome to multiple right and wrong answers as you navigate through the regulatory process, and company and state requirements.
