Federal Railroad Administration Extends Comment Period and Invites Comment on Canadian Human Rights Policy on Drug and Alcohol Testing

| On December 10, 2002, the Federal Railroad Administration (FRA) issued an extension for comments on their December 11, 2001 proposed rule, which would narrow the scope of its current exemptions of certain operations by foreign railroads. Specifically, the FRA is requesting comments on the July 10, 2002 Canadian Human Rights Policy on Alcohol and Drug Testing. The comment period is extended indefinitely until further notice. |

Question: I cannot seem to find a regulation that would cover these situations but maybe you can help. While doing a urine collection even from the very start our phone may ring several times. Is it permissible to stop with a collection in order to answer the phone? I do not like to do this because there is the possibility of not keeping visual contact with the specimen, etc. Any suggestions or regulations that address this issue?
Answer: The regulations state that both the collector and donor must maintain visual contact with the specimen until it is prepared for shipment. I do not see how this can be done if the collector leaves to answer the phone. Even if the donor follows the collector to where the phone is, the collector's attention will not be on maintaining visual contact with the specimen while he/she is on the phone. The collection site should have a person designated to answer the phone, and if this is not possible, if the phone rings during a collection the collector should allow the machine to take a message and then retrieve the message once the collection process has been completed and the specimen has been sealed.
