SAMHSA Announces Funding Opportunity for Prevention Efforts

The Substance Abuse and Mental Health Services Administration (SAMHSA) Center for Substance Abuse Prevention (CSAP) announced the availability of FY 2002 funds for cooperative agreements for Ecstasy, other Club Drugs, Methamphetamine and Inhalant Prevention Infrastructure Development. Organizations that may apply include community-based organizations, domestic private non-profit organizations, non-profit managed care, and others. Approximately $4 million will be available for 12 awards for up to $350,000 each for one year. Learn more about this grant opportunity.

Question: I've just recently took on a few rafting companies. These companies employ 5 or 7 bus drivers 6 consecutive weeks out of the year. My question is if 50% of 7 is about 4, divide that by 4 quarters and I should have to do 1 random drug test for this company to be compliant? Is that right? Note all drivers are getting a pre-employment drug test.

Answer:
No, your numbers are incorrect. Please read on and I will try to explain how you should look at this issue. If you have each company in its own pool, they have to test 50% for drugs and 10% for alcohol. In your example they would have to test 4 drivers for drugs and 1 driver for alcohol, they have to be tested in the timeframe that they work. So if they are not working, except those 6 weeks, those drivers will have to be tested in that 6 week cycle.

My suggestion would be to put these types of companies into one "consortium" random pool. The same as above would apply as to the average number of drivers would have to be selected at the FMCSA rates, currently 50% drugs and 10% alcohol. In your example, if all the companies' employees total 7 drivers the number of tests would have to be 4 drug and 1 alcohol. Those tests would have to be accomplished while they are working, so that it would be in the 6 week timeframe.

I would also suggest that you contact your local office of the FMCSA to see how they would suggest that those employers comply. FMCSA regulation part 382.305 is where you can find more information on random testing program.
