Broad Support for Student Drug Testing Surfaces in Wake of Supreme Court Ruling

Following the Supreme Court Ruling upholding the constitutionality of student drug testing for students in extracurricular activities, organizations that were previously silent on the issue or voiced opposition have issued statements in support of student drug testing. The Office of National Drug Control Policy (ONDCP), which was previously silent on the issue, announced its support of the local community’s ability to use testing as a tool to combat drug use. In addition, the Washington Post, which previously took a stance against student drug testing has stated its now support of the practice. The National Center on Addiction and Substance Abuse at Columbia University (CASA) also applauds the Supreme Court's decision. What does this mean? With a reported 70% of Americans supporting student drug testing, support for the practice crosses all party lines and segments of the American population.

Question & Answer: Excerpts from the DATIA Industry Forum

Question: We are confused on who we can bill for the cost of a split specimen test. Do we invoice the employer? The parts of the regulation do not seem to make this clear.

Answer:
This is where the Company policy comes into play. You or the Company needs to ensure that who pays for the split is added to Company Policy.

But it must be understood that if the employee says he will not pay for the Split, but he still wants the Split to be tested, the employer MUST pay for it. §40.173
