DATIA urges you to contact your local Senator and Representatives to request additional appropriations for drug and alcohol treatment, testing, prevention, and education.

Question & Answer: Excerpts from the DATIA Industry Forum

Question: We have several small companies (less than 5 employees) that are enrolled in a consortium. Are these companies responsible for testing their employees selected in the random, if the company has already tested 50% of the employee population or are they excused?
Answer: If the company is in the Consortium, it doesn't matter if they are at 50%, those tests need to be accomplished in order for the Consortium to be in compliance. That is one thing that a Consortium needs to make sure that the employer understands, that it is the Consortiums number of covered employees that must be tested not 50% of the employers employee. So they may have 100% of their employees tested in any year.
If the Consortium doesn't meet their number of random tests completed by year-end all Companies are in non-compliance with the random program.
If the employer wants to make sure that they don't have more then 50% of THEIR employees tested they need to be in a Company Random program, which can be administered by the Consortium.
