DATIA Responds to US News and World Report's Inaccurate Article Concerning Drug Testing

In the August 12, 2002 US News and World Report, an article titled Tests on Trial was published, which included many inaccurate and inflammatory statements and stories. DATIA has responded with a letter to the editor in an effort to defend the industry and its professionals who take pride in adhering to industry standards. Brian Walters, of Premier Drug Testing, has also contacted US News and World Report to express his dissatisfaction with the article. Question: Since the new regulations went into effect (Part 40) what are the training requirements for employers as pertains to Supervisors and to Employees concerning Drug and Alcohol testing? Where can the regs be found in Part 40 and/or 382?
Answer: Supervisor and employee training requirements did not change with the new Part 40 regulations. These requirements are contained in each of the modal agency regulations and there is no mention of supervisor or employee training in 49 CFR Part 40. The modal requirements can be found at the following references:
