Coast Guard Reopens Alcohol Testing Comment Period

The Coast Guard has reopened the comment period for those wishing to comment on its proposed post-accident alcohol testing regulations until November 20, 2003. Originally, the Coast Guard had scheduled a public meeting to discuss the proposed rule, however, the meeting was cancelled due to hurricane Isabel. Rather than rescheduling the meeting, the Coast Guard reopened the comment period. DATIA encourages all of its members to submit comments to the docket. DATIA previously submitted its comments to the Coast Guard, which were formulated with input from DATIAs Legislative and Regulatory Committee and Board of Directors. Question: Can someone please comment on any regulations regarding privacy of drug testing facilities. I am aware of observation and monitored collection procedures. I am interested in finding information that has to do with limiting the number of collections that are going on in a room at one time by two different collectors. Is it advisable to have only one collection going on at a time in a room. Note, both collections are being performed by two different collectors. We are concerned with the privacy of our clients and do not want to violate any governmental regulations.
Answer: You'll find in 40.43(d)(1), it states "To avoid distraction that could compromise security, you are limited to conducting a collection for only one employee at a time."
Although it does not specifically state in that part that collections need to take place in seperate rooms, our company uses the same rule that applies for alcohol testing. In 40.221(c) it states "If you are operating an alcohol testing site, you must ensure that it provides visual and aural privacy to the employee being tested, sufficient to prevent unauthorized persons from seeing or hearing test results."
I realize that no results are being disclosed while performing a UDS collection, but the donor is giving you personal information that should be kept confidential.
Another reason not to perform multiple collections in the same room is the fact that distractions may cause the collectors or donors to cause a mistake in the collection process that could lead to poor integrity of the specimen or perhaps a fatal flaw. The collector must keep complete control over the collection process.
