DATIA Participates in ONDCP Student Drug Testing Summit

On October 30, 2003, DATIA was honored to attend the Office of National Drug Control Policy’s (ONDCP) invitation-only summit on student drug testing. The purpose of the summit was to bring together leaders and experts from national organizations to discuss current research, technology, legal issues, and a host of additional issues surrounding drug testing of students. While at the summit, DATIA was able to network and create relationships with various organizations representing the interests of schools, school boards, and principals. DATIA will work to cultivate these relationships to allow for the expansion of student drug testing. We will keep you posted as we continue to further student drug testing programs.
Question & Answer: Excerpts from the DATIA Forum

Question: Is there any new information on the concurrent employers issue? I have an owner-operator client (FMCSA) who sometimes provides services for a local construction company. If I understand correctly, the client has to be in a consortium with his company AND in the construction company's consortium. Is that right?

Answer:This is true, what I always suggest is that either you or the employee contact the local FMCSA inspector to see what their feeling is. I have heard that some inspectors have different opinions.

DATIA Note: DATIA recommends that all members follow the current Federal interpretations only. Current interpretations say that the employee must be in both pools.
