National Student Drug-Testing Committee Releases Model State Law

On December 12, 2003, the National Student Drug-Testing Committee released model state legislation to support the creation of student drug testing programs. This model legislation was provided to assist legislators and education leaders in their efforts to eliminate drug use among students and the disruptive behaviors and safety issues that accompany student drug use. The model legislation utilizes accepted standards and practices for such programs based on federal and state case law and federal drug testing procedures. These standards serve to protect both schools and students. The National Student Drug-Testing Committee consists of experts in education, substance abuse, and drug testing, and is composed of lawyers, physicians, drug testing experts and parent advocates. DATIA has served on the committee since its inception, and actively supports student drug-testing initiatives. We encourage all DATIA members to engage in grass-roots activities to further this model legislation in your area. Question & Answer: Excerpts from the DATIA Forum

Question: Part 309.5 states that a vehicle over 10,001 pounds and used for interstate commerce is a CMV. Does that mean they are subject to DOT drug and alcohol testing requirements?

Answer: No, only 16+ passenger vehicles or vehicles weighing at least 26,001 pounds are subject to the DOT drug and alcohol testing rules. A Commercial Motor Vehicle(CMV) starts at 10,001 pounds, and they do have some regulations to comply with. However, they do not have to comply with the DOT drug and alcohol testing requirements. Effective Dec 10, 2003, 9-15 passenger "vans" used in commercial operations may be considered a CMV, but they don't have to comply with the D and A rules either.
