2002 Was a Monumental Year for DATIA Members

As we begin a new year, we find it a good time to reflect on the accomplishments and successes of the previous year. 2002 was a monumental year for DATIA and we are looking forward to building on our success to further increase opportunities for drug and alcohol testing providers. Highlights of 2002 include receiving press in the nation’s most prominent news sources (Wall Street Journal, USA Today, NY Times, etc.), working with our members to provide input to government agencies on proposed regulations affecting the industry, providing comprehensive training to industry professionals, and working with key agency officials to develop solutions to problems experienced by drug and alcohol testing professionals. Question & Answer: Excerpts from the DATIA Forum

Question: If an individual fails to test during a selection period are they required to complete THAT test before the year-end period? Will it count towards the year-end total?

Answer: Not all modes address this situation specifically, however, the FMCSA does in §382.305 (i) (3) "Each driver selected for testing shall be tested during the selection period." From my understanding, C/TPAs apply this rule to all modes and do not count the test if it was not conducted during the selection period. Depending on the reason the test was not conducted, it is either considered excused (i.e. employee on extended vacation) or a refusal to test (i.e. employee notified by employer, but never went to have sample collected).
