DATIA Announces 2003 Action and Agenda Items

Question & Answer: Excerpts from the DATIA Forum

Question: In your CPCT training manual, chapter 17,#6 states that if a DOT and a non-DOT specimen is needed that under no circumstance can one void be used for both the DOT and non-DOT specimens. The donor must make a separate void for the non-DOT collection. Is this specifically stated in the regulations governing DOT collections and if so where might I find the documentation of this for my clients who want both a DOT and a non-DOT collection?

Answer: The regulation concerning this is §40.71(b) (8), which states “You must discard any urine left over in the collection container after both specimen bottles have been appropriately filled and sealed. There is one exception to this requirement: you may use excess urine to conduct clinical tests (e.g., protein, glucose) if the collection was conducted in conjunction with a physical examination required by a DOT agency regulation. Neither you nor anyone else may conduct further testing (such as adulteration testing) on this excess urine and the employee has no legal right to demand that the excess urine be turned over to the employee.”
