DATIA Opposes Proposed FMCSA Exemption for United Van Lines and Mayflower Transit

| DATIA submitted comments to the Federal Motor Carrier Safety Administration opposing an exemption from certain drug and alcohol testing regulations for Mayflower Transit and United Van lines. DATIA outlined many reasons why allowing employers to include non-covered employees in the same pool as FMCSA covered employees would have far reaching negative effects on the FMCSA drug and alcohol testing program. | Question: What does a company do when their MRO goes on vacation or is not in the office, and will not be available to review the test within the regulated time frame?
Answer: The testing process must go on as regulated. As a result, all Companies should contract with a back-up MRO. The back-up MRO will perform the required duties of the MRO. Upon the return of the primary MRO, he/she will review the results of the interim for final approval.
Because, the primary MRO will review the results, it is not necessary to list the back-up MRO name on the chain of custody.
