Coast Guard to Hold Public Meeting on Proposed Post Accident Alcohol Testing Regulations


On August 25, 2003 the Coast Guard (CG) announced that it will be re-opening the comment period on the CG’s proposed post-accident alcohol testing regulations and holding a public meeting on September 19, 2003 in Washington, DC. In DATIA’s comments to the CG, we outlined numerous reasons for opposing the proposed regulation as written. DATIA will be presenting the following reasons for opposing the proposed regulation at the public meeting: (1) device storage requirements will be very hard to meet for devices stored on vessels, which will result in inaccurate tests, (2) employees on vessels that need to administer tests to each other will not be as objective as a third party and many tests are likely to be reported incorrectly, (3) screening tests are just that, they do not produce legally defensible test results and many do not give a quantitative result, and (4) giving the employer/employees involved in the accident the responsibility of performing the alcohol test and reporting the results sets a dangerous precedent. Question: Is it mandatory for a collector to fill out the entire employer information section on a CCF when the collector knows who the employer is and will be providing the MRO services for such collection?

Answer: Yes. The DOT regulations are very specific that the employer's name, address, telephone, and fax must be on the CCF. The employer may opt to list the address of their C/TPA, but the form must include the employer's name, phone, and fax. The collector may know the employer, but there are many other persons involved in the drug testing process, and the CCF must be a legally defensible document.
