DATIA Submits Concerns to DOT Regarding Substituted Specimen Rule

On August 4, 2003, the Drug and Alcohol Testing Industry Association (DATIA) submitted comments to the DOT regarding its interim final rule concerning substituted and dilute specimens. While DATIA supports the intent of the rulemaking, it identified areas of the regulation that need clarification. Such items include whether an MRO assistant can review test results with a creatinine level greater than 2mg/dL, and how MROs are to report specimens with a creatinine level less than 5mg/dL as positive or negative if the laboratories are not instructed to report that information. Question: Is it a fatal flaw if the BAT does not sign and does not print their name on the alcohol testing form? Can this be corrected or is the test cancelled?
Answer: Such an error will only lead to a cancelled test if it is not corrected in accordance with §40.271. This used to be an error that always caused the test to be cancelled, however, this changed when the new regulations went into effect in August of 2001.
