DATIA Submits Comments Opposing FMCSAs Proposed Rule to Lengthen Reporting of Driver Histories

On August 22, 2003, DATIA submitted comments in opposition to the FMCSAs proposal to require employers to research a potential drivers previous three years worth of drug and alcohol testing results. Currently, the requirement is to request the previous two years worth of results. DATIAs basis for opposing the proposal was that the current system is not working so there would be no benefit in increasing the time period. Question: Our local school district took over the transportation services for their school buses and drivers. The drivers, who were previously employed by an outside transportation company, are now school district employees. The district is requesting a list of the employees who had recently been seen at our collection site for drug and alcohol testing, so they don't duplicate tests. I am fairly certain I can't release the information, but wanted a second opinion.
Answer: You should not release that information unless the "district" has provided you with the appropriate releases.
We just had the opposite happen and the "contractor" decided to pre-employment test everyone. The "district" must pre-employment test all their new employees unless they can comply with the 40.25 and 382.413.
You must also comply with a request from the district if the employee has signed the request. Remember that you must comply with the above regs also.
