Department of Labor Signs Agreement with Four Labor Unions For a Drug Free Workplace Alliance

On October 11, 2004, the U.S. Secretary of Labor signed an alliance agreement with four international labor unions in a collaborative effort to improve worker health and safety through drug-free workplace programs. Representatives from the International Union of Operating Engineers; United Brotherhood of Carpenters and Joiners of America, International Association of Bridge, Structural, Ornamental, and Reinforcing Iron Workers, and International Brotherhood of Boilermakers also signed the agreement.
One of DATIA's top exhibitors, The Department of Labor's Working Partners division, will work closely with the Occupational Safety and Health Administration (OSHA) and the Mining Safety and Health Administration (MSHA) to promote the importance of a safe and drug free workplace to the union members. Question: As a TPA we manage many different companies. Now, the question is if we have a "Positive" test on a PE for one company and the same donor shows up at another company we handle wanting to be hired. We have actual knowledge that that person was positive...is it our duty or the MRO's duty to inform the 2nd employer ? There seems to be several opinions on this issue with the FMCSR.
Answer: You can release results to a third party only if the employee authorizes the release to the third party. I have had this problem in the past, and have been told by the FMCSA that we cannot release results without written authorization. Refer to CFR 49 §40.321 for the DOT’s regulations on releasing drug testing results as that section specifically mentions this situation.
