| DATIA Makes Drug Testing Recommendations to Major League Baseball |
The Drug & Alcohol Testing Industry Association (DATIA) today made recommendations to Major League Baseball (MLB) and the Major League Baseball Players Association (MLBPA) as the two organizations develop a new drug testing program for the sport. In the letter, DATIA highlights issues that must be addressed in formulating a drug testing program that is comprehensive, consistent, and fair, and will be a truly effective and credible testing program.

Question: Is it acceptable to use excess urine from a DOT test for a company required non-DOT test (assuming there is enough volume for both tests)?
Answer: Section 40.71 (8) of the 49 CFR Part 40 states that "you must discard any urine left over in the collection container after both specimen bottles have been appropriately filled and sealed. There is one exception to this requirement: you may use excess urine to conduct clinical tests (e.g., protein, glucose) if the collection was conducted in conjunction with a physical examination required by a DOT agency regulation. Neither you nor anyone else may conduct further testing (such as adulteration testing) on this excess urine and the employee has no legal right to demand that the excess urine be turned over to the employee."
If a non-DOT collection is also required by the company, it must be from a completely separate void.
