DATIA Seeks Members to Serve on a Committee

DATIA is seeking members to serve on various committee's that will assist DATIA in shaping the association's agenda and programs for the future. We rely on input from Committee members throughout the year for guidance on issues and activities that will affect the drug and alcohol testing industry.
DATIA has four committees that are called upon throughout the year for conference calls, votes, and requests for comments. The committees are: Legislative and Regulatory, Specimen Collection, Consortium/Third Party Administrator, and Conference. If you feel that you would be able to provide key input and participation on any of these issues, please fill out the Committee Interest Form and send it to DATIA by April 23, 2004.

Question: I was notified recently that there are several states that do not allow on-site screening tests to be done for employee testing. Is this meaning that they are not allowing the rapids to be used in this process?
Answer: Yes, if a state has prohibited on-site drug testing of employees, then you can not use rapid kits. However, you should be thoroughly knowledgeable of your states' laws. Some states that permit on-site testing may have requirements that can limit certain aspects of this type of testing. For instance, some states may not totally outlaw the use of on-site testing, but they do require that a confirmation be done when an on-site test has a positive result, or a state may only allow on-site testing for pre-employment tests.
Collection facilities should not only be aware of their state drug and alcohol testing laws, but their state laboratory regulations as well. The laboratory regulations may also have an effect on the use of on-site testing kits.
The Department of Labor (DOL) has provided a state drug and alcohol testing guide on their website at http://said.dol.gov/StateLaws.asp. This should be helpful to anyone seeking state law information.
