How to Submit Comments on Proposed Rules

As an association, DATIA submits comments on behalf of its members; however, it is imperative that individual members also submit comments. Numbers matter, and the more comments submitted in support of or opposition to a proposed regulation are the better. Below are guidelines to assist you in submitting comments on proposed rules. If you have any questions, please contact DATIA at 800-355-1257.

DOT Regulations
Log onto http://dms.dot.gov
Select Simple Search
Enter the docket number (leave out the agency and year)
Follow instructions to submit comments electronically

For all other agencies
See Action Section of the proposed rule to find the Docket number. If it is not there, refer to the last sentence of the document (FR Doc. 0X-XXX). The action section is located at the beginning of the document.

See the Addresses section of the rule to see where to send comments, Most accept mail, fax, and electronic comment submissions. If all fails and you cannot find the docket number of a regulation or proposed regulation, look for the line the regulation. It will most definitely be included there.

Question: I cannot find anywhere in the Part 40 that Breath Alcohol Technicians must have certificates and copies of these certificates must be given to C/TPA, employers, etc. upon request. We have many TPA's that request these certficates and I am at a loss on why. Was this something that was done in the past and has continued on?

Answer: Section 40.213 (g) What training requirements must STTs and BATs meet? in the 49 CFR Part 40 states that "you must maintain documentation showing that you currently meet all requirements of this section. You must provide this documentation on request to DOT Agency Representatives and to employers and C/TPA's who are negotiating to use your services.
