While DATIA is in the process of finalizing the association’s comments on the Department of Health and Human Services’ (HHS) proposed changes to the Mandatory Guidelines for Federal Drug Testing Programs, we strongly encourage each member of DATIA to submit individual comments. It is important that HHS receives feedback from those affected on how these proposed guidelines will affect your operations. | DOT Releases Questions and Answers to Clarify Regulations |

On June 22, 2004 The Department of Transportation released two Q&A's in attempt to clarify issues regarding 49 CFR Part 40. The first one relates to the 40.25 employer requirement to obtain prospective employee drug and alcohol testing information from prior employers. There has been some confusion between the Part 40's requirement for two years of data and the Federal Motor Carrier Safety Administration's recent implementation of a three-year requirement background check (49CFR Part 391). There was also concern regarding the Federal Aviation Administration's requirment to obtain five years of information under the Pilot Record Improvement Act.
The second Q&A clarifies Medical Review Officer and employer requirements in the event no laboratory is available to test a split specimen for an adulterant identified in the primary specimen.

Question: I am looking for BAT training courses. Does DATIA provide this type of training?
Answer:No, DATIA does not provide Breath Alcohol Technician (BAT) training. DATIA recommends that you go to the manufacturer of the device that you use for that training.
