Your peers have submitted comments to the HHS proposed guidelines for alternative specimen testing. Why haven't you? It is extremely important that all DATIA members take a little time to submit comments to the HHS proposed guidelines.
View the comments already submitted to SAMHSA concerning their proposed rules. Maybe you will agree with comments that have already been submitted. Your comment can be as simple as stating that you support the comments made by another individual or organization.
The Department of Transportation (DOT) has even put out a notice suggesting, that the drug and alcohol testing industry submit comments to the HHS proposed guidelines. The DOT is required to consider any final rules that are released from HHS with regards to drug and alcohol testing. This means that the DOT's 49 CFR Part 40 could very well change to incorporate some of the HHS guidelines once they are finalized. Take a look at the DOT notice.
What is proposed now can very easily become a final rule. Once the rules are final, you and your clients will be forced to adhere to them. The deadline for comment submission is Monday July 12, 2004.

Question: Can you clarify that if a driver flushes the toilet during the collection process, I know it has been ruled not an attempt to adulterate. (So no need to do direct observe) Does the collector only mark in the remarks section that the donor flushed against directions given and send out the specimen collected? Or does the donor need to provide all new specimen?
Answer: You are correct. The DOT has told DATIA that flushing the toilet does not clearly indicate an attempt to adulterate the specimen, and does not in and of itself require a second collection. To avoid flushing of the toilet, the collector should ensure that the handle for flushing is secured with tamper evident tape prior to beginning the collection.
