Capitol Hill Examines Several Facets of Drug Testing


This week has been the most active one in memory for drug testing, with hearings addressing two major issues that will impact DATIA members. There has been much information circulated and press coverage of these issues, and some of it is misdirected.  The following is intended to highlight the relevant facts and points of the action:

Adulteration Products—A Federal Ban May be on the Way

DATIA and other groups testified before Congress this week about products that are specifically meant to thwart drug tests, and now DATIA is calling for federal legislation that ends the manufacturing, sales, distribution, transportation, and shipping of products meant to thwart a legal and legitimate drug test. Fourteen states have laws intended to curb the use of such products, but the piecemeal effect simply does not work.  The only solution is federal legislation.

 DOT regulations, penalties, and employment consequences are not at issue. Any changes to testing regulations will be decided by the DOT, as the Commerce and Energy Committee does not have jurisdiction over DOT or their regulatory scheme.

Sports Testing—One Standard is Emerging

DATIA is happy to see that the introduction of the Drug Free Sports Act is moving professional sports toward a uniform Olympic-level drug-testing standard. Just as DOT is seen as the gold standard for workplace drug testing, the anti-doping rules of the Olympics are seen as the gold standard for sports testing.

The Act also stresses the importance of third party administrators as the key component to a fair, consistent, and effective drug testing program.

What You Can Do

As these important initiatives move forward, DATIA will rely on our membership for their support and action.  When appropriate, DATIA will ask you to write to your member of congress in support of the bills, and to spread information to your colleagues,  clients, and local media.
