DATIA Announces Newest Industry Training Course!


DATIA is proud to announce the newest addition to our series of drug and alcohol testing industry training courses … DER Compliance: A Train-the-Trainer Workshop on the Drug and Alcohol Testing Responsibilities of Employers.

This new course will instruct representatives of Consortia/Third Party Administrators (C/TPAs) on the roles and responsibilities of the Designated Employer Representative (DER) in drug and alcohol testing as prescribed in the Department of Transportation’s 49 CFR Part 40 from the DER’s perspective.

After completing this course, C/TPAs can hold training courses for DERs at client companies, or local company DERs, with materials provided by DATIA.  After receiving this professional industry instruction, DERs may take an exam and be certified by DATIA.

DATIA training already exists for collectors, C/TPAs, and MRO Assistants—this training provides standards and education for individuals making up the final link in the mandated drug testing chain.

Question & Answer From DATIA's Forum:

Question: What is the difference, if any, between a correctable flaw picked up by the collector and when a collector receives an affidavit from the lab indicating that there is a wrong date, no specimen temperature checked, etc.?

Answer: The affidavit from the lab and a correctable flaw noticed by the collector, require the same course of action. Upon notification or awareness of the correctable flaw, the collector is required to either fill out a form provided by the lab or MRO requesting the correction, or the collector can write a short affidavit on their company letterhead stating the correction needed.

Section 40.205 (b) of the 49 CFR Part 40, states that "if, as a collector, laboratory, MRO, employer or other person implementing these drug testing regulations, you become aware of a problem that can be corrected (see § 40.203), but which has not already been corrected under paragraph (a) of this section, you must take all practicable action to correct the problem so the test is not cancelled."
